FOUR YEARS RIGOROUS IMPRISONMENT WITH FINE OF Rs. 1,00,000/- TO THE THEN ADDITIONAL CIVIL JUDGE, BATHINDA

The Special Judge, CBI Cases, Chandigarh has convicted Shri M.S.Walia, the then Additional Civil Judge, Senior Division, Bathinda (Punjab) and sentenced him to undergo four years Rigorous Imprisonment with fine of Rs. one lakh in a Disproportionate Assets case. The Court also ordered for confiscation of properties of accused to the tune of Rs.52,40,049.50 (portion of House No.311, Sector 9-D, Chandigarh), Navneet Paper Mill & movable properties and also forfeiting of an amount of Rs.29,69,701/- from the assets of the accused.

CBI had registered a case on 24.03.1998 U/s 13(1)(e) r/w 13(2) of Prevention of Corruption Act, 1988, Act, 1988 against Shri M.S.Walia, the then Additional Civil Judge, Senior Division, Bathinda in pursuance of the orders dated 27.02.1998 in Crl Misc. No.4716-M of 1998 of Hon’ble High Court of Punjab and Haryana, Chandigarh, directing therein to take over the investigation of case FIR No.10 dated 03.02.1998, earlier registered at Police Station North, Chandigarh against Shri M.S.Walia, the then Civil Judge on the allegations of possession of disproportionate assets. After investigation, CBI filed chargesheet in the Court of Special Judge, CBI, Chandigarh. During trial of the case, accused approached Hon’ble Supreme Court vide SLP (Crl.) No.3919 of 2012, however the same was dismissed by the Hon’ble Apex Court on 30.03.2016.

The Trial Court found the accused guilty and convicted him.
