FIVE YEARS RIGOROUS IMPRISONMENT WITH FINE OF RS. ONE LAKH TO THEN COLONEL OF WESTERN COMMAND

The Special Judge, CBI cases, Chandigarh has convicted Sh. B.S.Guraya, then Colonel of Western Command and sentenced him to undergo five years Rigorous Imprisonment with fine of Rs. One lakh. The Court has also ordered for confiscation of properties of accused worth Rs.66,94,455.82.

A case was registered on 06.08.1990 under section 13(2) r/w 13(1)(e) of PC Act, 1988 against Sh. B.S.Guraya, Colonel, General Staff (Engg.), Head Quarters, Western Command. It was alleged that Col Guraya had amassed assets to the tune of Rs.90 lakh (approx) which was disproportionate to his known sources of income. After completion of investigation, charge sheet was filed in the Court of Special Judge, CBI, Chandigarh on 29.04.1993. The trial court had ordered framing of charges on 06.02.1998, however, the accused filed a petition in the Hon’ble High Court of Punjab & Haryana, Chandigarh, challenging the framing of charges. On 29.09.1998, the petition of the accused was dismissed by the Hon’ble High Court. Subsequently, the accused filed an SLP in the Hon’ble Supreme Court against the orders of Hon’ble High Court. The Hon’ble High Court vide order dated 03.05.1999 stayed the trial of the case. The Hon’ble Supreme Court vacated the stay on 23.07.2007 and thus the regular trial of the case started in May, 2009. The prosecution examined 66 witnesses to prove its case and Defence examined 76 witnesses.

The Trial Court found the accused guilty and convicted him.
