LIFE IMPRISONMENT TO FOUR THEN OFFICIALS OF UTTAR PRADESH POLICE IN A CASE RELATING TO KILLING OF FOUR LABOURERS IN AN ENCOUNTER

         The Special Judge, CBI Cases, Ghaziabad (Uttar Pradesh) has sentenced S/Shri Lal Singh, then SO; Joginder Singh, then Sub Inspector; Surya Bhan, then Constable & Subhash Chander, then Constable, all working in the Police Station Bhojpur(UP) to undergo Life Imprisonment with fine of Rs. Two Lakh to then SO, Rs.One Lakh to then SI & Rs.50,000/- each to then Constables U/s 302 of IPC. The Court has further imposed two years Rigorous Imprisonment with fine of Rs.10,000/-each for offence U/s 193 of IPC and four years Rigorous Imprisonment with fine of Rs.20,000/-each for offence U/s 201 of IPC on all the accused. All the sentences will run concurrently. The court has further directed that 50% of the total fine will be given equally to the family members of all the four victims.

            CBI registered the case on 10.04.1997 on the request of Uttar Pradesh Government and took up the investigation vide Crime No.142/96, 143/96, 144/96, 145/96 & 146/96, registered earlier at Police Station Bhojpur, District Ghaziabad(UP). It was alleged that four persons, namely S/Shri Jasbir Singh, Jalaluddin, Ashok & Pravesh, all residents of District Ghaziabad, were shot dead in an encounter by police officials of Police Station Bhojpur on 08.11.1996 when these persons allegedly opened fire at the police party.

          Investigation conducted by CBI disclosed that four innocent persons were killed by police on 08.11.1996 in an encounter. They had no criminal record and were not required by Bhojpur Police Station or any of the nearby Police Stations in any criminal case. They had no fire arms with them and did not fire at the police party as falsely shown in the FIR. The investigation further revealed that the deceased were working as labourers and were picked up by the police officials of Police Station: Bhojpur on 08.11.1996. Subsequently, they were taken to Macheri ki pulia on Modi Nagar-Hapur Road (UP) and shown killed in an encounter.

           After thorough investigation, CBI filed a chargesheet against the five accused persons during 2001. During trial, one Constable died. 99 prosecution witnesses were examined.

            The Trial Court found the four accused persons guilty and convicted them on 20.02.2017.
